Constitution of India, Art. 21 – Life of dignity – Society must have sympathy towards the sex workers – They are entitled to a life of dignity in view of Art 21 of the constitution – Direction to prepare schemes for giving technical/vocational training to sex workers and sexually abused women in all cities in India.

Code of Criminal Procedure, 1973; S. 439 ----- Grant of Bail ----- The court granting bail should exercise its discretion in a judicious manner and not as a matter of course ---- Though at the stage of granting bail a detailed examination of evidence and elaborate documentation of the merit of the case need not be undertaken, there is a need to indicate in such orders reasons for prima facie concluding why bail was being granted particularly where the accused is charged of having committed a serious offence ----- Any order devoid of such reasons would suffer from non-application of mind ----- It is also necessary for the court granting bail to consider, among other circumstances, the following factors also before granting bail; they are: (a) The nature of accusation and the severity of punishment in case of conviction and the nature of supporting evidence. (b) Reasonable apprehension of tampering with the witness or apprehension of threat to the complainant. (c) Prima facie satisfaction of the court in support of the charge.

Evidence Act, 1872; S. 27 – Confessional statement -- Applicable only if the confessional statement leads to the discovery of some new fact – The material objects which the police is claimed to have recovered from the accused may well have been planted by the police, the bench said -- the settled legal proposition that Section 27 of the Evidence Act is applicable only if the confessional statement leads to the discovery of some new fact while setting aside the conviction in a murder case

Code of Civil Procedure, 1908; O. 7 R. 11 (d) -- Rejection of Plaint -- the has to be read as a whole -- The defence available to the defendants or the plea taken by them in the written statement or any application filed by them, cannot be the basis to decide the application under Order VII Rule 11(d) -- Only the averments in the plaint are germane -- The issue regarding the suit being barred by limitation in the facts of the present case, is a triable issue and for which reason the plaint cannot be rejected at the threshold in exercise of the power under Order VII Rule 11(d).

Constitution of India; Art. 14 and 21 -- Recognition of third gender –

Held: the Court upheld transgender persons’ right to self-identify their gender. The Constitution requires equal treatment of all people regardless of their gender identity or expression. The Court declared that the Centre and State governments must grant legal recognition of gender identity as male, female or third gender. A full recognition is to be given even in the absence of any existing statutory regime. Additionally, the Court declared that educational, social and health care issues faced by transgender people must be addressed both at the centre and state government levels.

Negotiable Instruments Act, 1881; S. 138 ------ Compounding the offence under Section 138 of the Negotiable Instruments Act, 1881 (the Act) on payment of the cheque amount and in the alternative for exemption from personal appearance ----- Held that where the cheque amount with interest and cost as assessed by the Court is paid by a specified date, the Court is entitled to close the proceedings in exercise of its powers under Section 143 of the Act read with Section 258 Cr.P.C.

Negotiable Instruments Act, 1881; S. 138 ------ Service of summons ----- Mode of ----- The service of summons can be by post/e-mail/courier and ought to be properly monitored (Para 16).

Negotiable Instruments Act, 1881; S. 138 ------ Implementation of technology ----- Use of modern technology needs to be considered not only for paperless courts but also to reduce overcrowding of courts ----- There appears to be need to consider categories of cases which can be partly or entirely concluded “online” without physical presence of the parties by simplifying procedures where seriously disputed questions are not required to be adjudicated. Traffic challans may perhaps be one such category ----- Atleast some number of Section 138 cases can be decided online ----- If complaint with affidavits and documents can be filed online, process issued online and accused pays the specified amount online, it may obviate the need for personal appearance of the complainant or the accused ----- Only if the accused contests, need for appearance of parties may arise which may be through counsel and wherever viable, video conferencing can be used ----- Personal appearances can be dispensed with on suitable self operating conditions. (Para 17)

General Clauses Act, 1897; S. 27 -----  Evidence Act, 1872; S. 114 -----
Negotiable Instruments Act, 1882; S. 138 ----- Whether it is necessary to state that the notice issued under Section 138 of the NI Act by the complainant was served upon the respondent-accused on any specific date ----- Held: since the NI Act does not require that notice should only be given by ‘post’ in a case where the sender has despatched the notice by post with correct address written on it, Section 27 of the GC Act could be profitably imported and in such a situation service of notice is deemed to have been effected on the sender unless he proves that it was really not served and that he was not responsible for such non-service ----- Section 114 of the Evidence Act enables the Court to presume that in the common course of natural events, the communication would have been delivered at the address of the addressee.

Code of Criminal Procedure, 1973; S. 205 ------ Exemption from personal appearance ----- Case under section 498A IPC read with S.4 of D.P. Act at Patna ----- Appellant No. 1 is a retired Army personal and residing in Pune, Appellant No. 2, Appellant No. 3 and 4 are also resident of Pune and the husband is working in Hyderabad ------- The appellants are engaged in their respective jobs at their respective places ------ Sufficient grounds are there to allow application under section 205 Cr.P.C.

Code of Criminal Procedure, 1973; S. 154 – Registration of F.I.R. – The mandate upon the Police – Held: (i) Registration of FIR is mandatory under Section 154 of the Code, if the information discloses commission of a cognizable offence and no preliminary inquiry is permissible in such a situation. (ii) If the information received does not disclose a cognizable offence but indicates the necessity for an inquiry, a preliminary inquiry may be conducted only to ascertain whether cognizable offence is disclosed or not. (iii) If the inquiry discloses the commission of a cognizable offence, the FIR must be registered. In cases where preliminary inquiry ends in closing the complaint, a copy of the entry of such closure must be supplied to the first informant forthwith and not later than one week. It must disclose reasons in brief for closing the complaint and not proceeding further. (iv) The police officer cannot avoid his duty of registering offence if cognizable offence is disclosed. Action must be taken against erring officers who do not register the FIR if information received by him discloses a cognizable offence. (v) The scope of preliminary inquiry is not to verify the veracity or otherwise of the information received but only to ascertain whether the information reveals any cognizable offence. (vi) As to what type and in which cases preliminary inquiry is to be conducted will depend on the facts and circumstances of each case. The category of cases in which preliminary inquiry may be made are as under: (a) Matrimonial disputes/ family disputes (b) Commercial offences (c) Medical negligence cases (d) Corruption cases (e) Cases where there is abnormal delay/laches in initiating criminal prosecution, for example, over 3 months delay in reporting the matter without satisfactorily explaining the reasons for delay. The aforesaid are only illustrations and not exhaustive of all conditions which may warrant preliminary inquiry. (vii) While ensuring and protecting the rights of the accused and the complainant, a preliminary inquiry should be made time bound and in any case it should not exceed 7 days. The fact of such delay and the causes of it must be reflected in the General Diary entry. (viii) Since the General Diary/Station Diary/Daily Diary is the record of all information received in a police station, we direct that all information relating to cognizable offences, whether resulting in registration of FIR or leading to an inquiry, must be mandatorily and meticulously reflected in the said Diary and the decision to conduct a preliminary inquiry must also be reflected, as mentioned above.

Land Encroachment Act, 1905; S. 6, 7 – Evidence Act, 1872; S. 90, 110 – Presumption of title as a result of possession, can arise only where facts disclose that no title vests in any party -
- Possession of the plaintiff is not prima facie wrongful, and title of the plaintiff is not proved -- It certainly does not mean that because a man has title over some land, he is necessarily in possession of it -- if at any time a man with title was in possession of the said property, the law allows the presumption that such possession was in continuation of the title vested in him -- person must establish that he has continued possession of the suit property -- other side claiming title, must make out a case of trespass/ encroachment etc -- mere acceptance of municipal tax or agricultural tax by a person, cannot stop the State from challenging ownership of the land -- Nor can such a presumption arise in case of grant of loan by a bank upon it hypothecating the property -- revenue records confer title, for the reason that they merely show possession of a person -- Held: A revenue record is not a document of title -- It merely raises a presumption in regard to possession
